1. THE GOLD HELMET COMPREHENSIVE TRADEMARK SEARCH

  • The first step in any trademark registration is to make sure your trademark is original and does not infringe on anyone else’s trademark. Just because another person’s trademark is not registered, does not mean you can claim ownership of the trademark by quickly registering the trademark first. To increase your chances of obtaining Federal approval/registration for your trademark, you need to complete an extremely thorough search upfront. The last thing you want is to pay filing fees and invest significant amounts of money into building your brand around a trademark that ends up being rejected by the United States Patent and Trademark Office (USPTO).

2. BLACK GAVEL FEDERAL TRADEMARK APPLICATION

  • Lawvant-guard Legal will complete the Federal application and submit the application to the USPTO. The process is far from over at this point. The firm will track the application until it is officially approved by the USPTO (United States Patent and Trademark Office). This typically requires responding to questions and providing necessary clarifications when the USPTO returns the application for various reasons. If an applicant does not respond in the given time period, the application is discarded, and the applicant must start the process over. This can be quite costly, not only monetarily, but in terms of precious time that you and your business will not get back. Getting an approved trademark is a lengthy process that can take, on average, six months to a year. Our goal is to make the application as clear and descriptive as possible, in order to reduce the chances of it being sent back for clarifications or discarded completely.

  • This option is for people who believe their trademark is completely original. That means you have done extensive searching for similar marks on your own and are confident moving forward without opting for the comprehensive search. I always urge you to have a comprehensive search done by a licensed attorney; otherwise you risk having your application returned or denied. This will set you back monetarily and prolong the time in which your mark is vulnerable due to lack of federal protection. I would never recommend filing a trademark application without a comprehensive search. However, if you are comfortable moving forward, this option allows you to have your application filled out, submitted, and tracked by a professional trademark attorney.
